Dear Ms. Ackerman-Casselberry,

I am writing to you to respectfully request that Delta County prioritize the protection of public health and safety in reviewing Gunnison Energy’s proposed Iron Point and Trail Gulch 3D Seismic Mapping Specific Development Applications.

The regulatory gaps surrounding these projects, and the potential these two projects have to wreak havoc on our watershed warrants heightened scrutiny. The applications submitted by Gunnison Energy fail to adequately describe how unexploded ordinances will be dealt with and how groundwater contamination will be avoided. They also fail to describe an appropriate means of plugging the shot holes that encounter groundwater. The applications rely on a “standard procedure” for plugging shot holes that fails to comply with COGCC regulations, and leaves unexploded ordinance and scrap metal buried underground.

These failures are completely unacceptable. Our watershed deserves better, and Delta County must ensure that groundwater resources in the North Fork Valley are not irreparably harmed by these seismic mapping projects. The public deserves to know how the County plans to address these regulatory gaps and risks prior to an administrative approval.

For those reasons I request a public meeting at which the County can explain how it plans to address the current regulatory gaps that threaten the watershed prior to an administrative decision.
